The Louisiana Supreme Court is temporarily blocking retired Judge Calvin Johnson from taking over as interim Orleans Parish clerk.
The court's decision on Thursday leaves Chelsey Richard Napoleon in the position.
The New Orleans City Council voted this week to appoint Johnson as interim clerk and call a special election in November for the newly combined Orleans Parish clerk's office.
After the state legislature recently merged the civil and criminal clerkships, the city council said the state had created a new office that calls for an election.
