The Louisiana Supreme Court is rejecting an insurance claim by a bicyclist who was hit by a drunk driver during Mardi Gras in 2019.
The high court unanimously ruled in favor of State Auto Property and Casualty Insurance Company.
Penelope Catzen had named the company as a defendant in her personal injury lawsuit because it had issued a policy to her father in Maryland.
The justices agreed that Catzen, as a New Orleans resident, didn't fit the insurer's definition of a family member because she didn't live in her father's household.
